Terms of Service.

By accessing or using the Auctionmen platform ("Platform"), operated by Mechanikos Sdn Bhd ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must immediately cease use of the Platform.

These Terms constitute a legally binding agreement between you and Mechanikos Sdn Bhd, governed by the laws of Malaysia.

Auctionmen is a high-frequency, hybrid auction transaction engine designed to synchronize real-time physical and remote bidding environments. The Platform is a white-label solution licensed to auction houses, banks, legal institutions, and private sellers ("Operators").

Mechanikos Sdn Bhd acts as a technology provider. The Operator deploying the Platform is solely responsible for the conduct of their auctions, the accuracy of asset listings, and compliance with all applicable auction and property laws.

To participate in auctions, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction.
• Complete the e-KYC (Know Your Customer) identity verification process successfully.
• Provide accurate, current, and complete registration information.
• Not be barred from participating in auctions under any applicable law.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

By placing a bid on the Platform, you acknowledge and agree that:

• All bids are legally binding offers to purchase the asset at the bid price.
• A bid cannot be retracted once submitted unless explicitly permitted by the Operator's auction rules.
• The highest accepted bid at the fall of the gavel (physical or digital) constitutes a contract of sale, subject to the Operator's terms and any applicable reserve price conditions.
• You are financially capable of completing the purchase if you are the successful bidder, including payment of any required deposit and outstanding balance within the stipulated timeframe.
• Shill bidding, bid manipulation, or any fraudulent activity is strictly prohibited and may result in account termination and legal action.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable regulation.
• Attempt to gain unauthorised access to any part of the Platform, its servers, or related systems.
• Interfere with or disrupt the integrity or performance of the Platform or auction sessions.
• Scrape, crawl, or systematically extract data from the Platform without express written permission.
• Impersonate any person or entity or misrepresent your identity or affiliation.

All content, features, and functionality of the Auctionmen Platform — including but not limited to the Micro-Sync Architecture, the Mercure-based real-time bidding engine, the user interface, source code, and branding — are the exclusive intellectual property of Mechanikos Sdn Bhd and are protected by Malaysian and international copyright, trademark, and patent laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform solely for participation in authorised auctions. No other rights are granted.

The Platform is provided on an "as is" and "as available" basis. Mechanikos Sdn Bhd makes no warranties, express or implied, regarding the Platform's uninterrupted availability, accuracy of asset listings, or suitability for a particular purpose.

To the fullest extent permitted by Malaysian law, Mechanikos Sdn Bhd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to loss of data, missed bids due to connectivity issues, or errors in asset valuation information provided by Operators.

Our total aggregate liability to you for any claim shall not exceed MYR 500 or the amount you paid to access the Platform in the three months prior to the claim, whichever is lower.

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms to the Platform with a revised "Last updated" date. Your continued use of the Platform after any such change constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
